Senior Partner Robert Lemen recently secured a complete victory for a Murtaugh LLP client in a trust litigation matter tried before the Hon. Ebrahim Baytieh in the Orange County Superior Court, Probate Department.
Our client’s late father had reached an agreement with her brother to relinquish his inheritance so the trust could support her ongoing medical care. After their father passed away, the brother challenged that agreement, claiming fraud and alleging that our client breached her fiduciary duties as successor trustee.
Following a six-day trial and extensive briefing, the court issued a 92-page decision in our client’s favor on all claims.
